By accessing or using NXround ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
NXround provides an AI-powered interview screening platform that enables companies to conduct automated first-round interviews with candidates. The Service includes:
- AI-conducted voice interviews
- Automatic transcription and recording
- AI-powered scoring and summarization
- Candidate scheduling and management
- Team collaboration features
3. User Accounts
To use certain features of the Service, you must create an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly notify us of any unauthorized access
- Accept responsibility for all activities under your account
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Discriminate against candidates based on protected characteristics
- Collect sensitive personal data without proper consent
- Interfere with or disrupt the Service or servers
- Attempt to gain unauthorized access to the Service
- Use the Service for any illegal or unauthorized purpose
- Misrepresent the nature of the AI-conducted interviews to candidates
5. AI-Assisted Screening Disclaimer
IMPORTANT: The AI scoring and analysis provided by NXround is intended as decision support only. You acknowledge and agree that:
- AI scores should not be the sole basis for hiring decisions
- Human review is recommended before making any employment decisions
- You are responsible for ensuring compliance with employment laws
- The AI may produce errors or biases despite our efforts to minimize them
- Final hiring decisions are your sole responsibility
6. Candidate Consent
When using the Service to interview candidates, you agree to:
- Inform candidates that the interview is conducted by AI
- Inform candidates that the interview will be recorded
- Obtain any required consent under applicable laws
- Comply with all applicable employment and privacy laws
7. Data Retention and Deletion
Our data retention practices:
- Video and audio recordings are automatically deleted after 10 days
- You may delete candidate data at any time through the Service
- Deleted data may be retained in backups for a limited period
- We may retain anonymized or aggregated data for analytics
8. Intellectual Property
The Service and its original content, features, and functionality are owned by NXround and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of your interview questions and configurations.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NXROUND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, data, or business opportunities
- Hiring decisions made based on AI scoring
- Service interruptions or data loss
- Errors or inaccuracies in AI analysis
10. Indemnification
You agree to indemnify and hold NXround harmless from any claims, damages, losses, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Your hiring decisions or employment practices
11. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue the Service at any time with reasonable notice.
12. Termination
We may terminate or suspend your account at any time for violation of these Terms. Upon termination, your right to use the Service will immediately cease. You may request export of your data before account closure.
13. Changes to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which NXround operates, without regard to conflict of law principles.
